This Terms and Conditions document constitutes a legally binding contract (the “Agreement”) between V Universal Nursing Care (the “Nursing Care,” “We,” “Us,” or “Our”) and the party engaging in our services (the “Client,” “Caregiver,” or “User”).

By accepting a service contract or by using any service provided by us, you agree to be bound by these Terms and Conditions. This Agreement is governed by the laws of Malaysia.

  1. Scope of Services
    1. The Nursing Care is a private entity established in Malaysia to provide a comprehensive and flexible range of professional health care services, including caregiver and/or nursing services, to assist the Care Recipient with day-to-day living.
    2. Service Commencement: This Agreement operates on a Monthly auto-renewal basis and shall commence on the date of the Caregiver’s arrival at the Client’s specified address.
    3. Caregiver Assurance: The Nursing Care will select and/or recommend a desired caregiver to the client and confirms the caregiver shall have a certificate that he or she is free from COVID-19-related symptoms and virus upon commencement. The Nursing Care takes full responsibility that the caregiver shall perform all assigned duties diligently, faithfully, and sincerely.
    4. Caregiver Replacement: Should the Caregiver be unable to perform their duties, the Nursing Care shall provide a replacement within 48 hours upon receiving written notice from the Client. If the caregiver is on leave, a temporary or alternative caregiver will be provided free of charge.
  2. Client and Caregiver Obligations
    1. Duties of the Caregiver
      The Caregiver is required to perform duties including, but not limited to:
      Providing personal care and assistance (bathing, grooming, dressing, walking).
      Observing, evaluating, and recording symptoms of the care recipient.
      Organizing and storing medications and providing reminders for doses.
      Taking necessary measures to notify the physician and/or family members in the event of an emergency.
      Taking care of the rehabilitation care plan for the Care Recipient to improve.
      Monitoring the care recipient for safety, including minimizing wandering and fall risks.
      Providing companionship and facilitating entertainment.
    2. Duties of the Client
      The Client agrees to:
      Provide the Caregiver with reasonable accommodation and basic amenities if engaged on a monthly basis.
      Provide reasonable and sufficient daily meals during duty time.
      Limit Instructions: Not require or instruct the Caregiver to perform any duty other than those stipulated under the core duties of the agreement.
      Respect Religious Beliefs: At all times respect the religious beliefs of the Caregiver, including the right to perform prayers and to refuse to handle and consume non-halal food for Muslim caregivers.
  3. Payment and Fees
    1. Service Fees: Payments for the monthly service package (RMXXXX.XX) are due according to the following schedule:
      Booking Fee: RMXXXX.XX (nonrefundable) payable upon confirmation of the selected caregiver.
      Balance Payment: Payable within seven (7) days after signing acceptance of the service contract.
      Subsequent Payments: Due on the 2nd week of the following month.
    2. Payment Method: All payments shall be made directly to V Universal Nursing Care.

    3. Extra Charges:
      Extra Hours: If the Client requests services for Extra hours, a rate of RM35.00 will be charged for each additional hour.
      Hospital Sitter Fee: If the Care Recipient is in a government hospital and the Caregiver is required to be situated in the relevant facility, the Nursing Care will charge an extra RMXXX.XX per day as a hospital sitter.
      Service Interruption: If the case is stopped in unavoidable circumstances, the Nursing Care will charge fifty (50%) percent of the fee related to the number of days remaining to provide the service.
  4. Termination of the Contract
    1. Termination by Client (Notice): The Client must give fourteen (14) days’ notice in writing to the Nursing Care to terminate monthly services.
      Penalty: Failure to provide the required 14 days’ written notice will make the Client liable to pay the Nursing Care for fourteen (14) days of service.
    2. Hospitalization Notification: The Client should immediately notify the Nursing Care if the patient is admitted to the Intensive Care Unit (ICU) or High Dependency Ward (HDW). In this event, the Client and the Nursing Care must mutually agree on the situation and proceed accordingly.
    3. Anti-Solicitation: The Client shall not entice the Caregiver to provide services directly to the Client to breach this agreement. The Nursing Care reserves the right to take legal action regarding such issues. We accept no responsibility for any dealings not related to this Agreement.
  5. Legal Provisions
    1. Governing Law: This Agreement shall be governed by, and construed by, the laws of Malaysia.
    2. Jurisdiction: Any legal action arising out of this agreement may be instituted in any court located in Malaysia.
    3. Entire Agreement: This document sets forth the entire understanding and supersedes all prior agreements.
    4. Time of Essence: Time, whenever mentioned, shall be the essence of this agreement.
